NEW YORK (AP) - New York State Sen. Pedro Espada, Jr. plans to file a formal complaint against Bronx District Attorney Robert Johnson.
The dissident Democrat who helped Republicans take over the Senate says he'll ask the Inspector General on Wednesday to investigate Johnson for "prosecutorial misconduct and selective prosecution."
Espada claims Johnson has subpoenaed his New York State Senate records, including member items and residency, dating back to 1993. He says Johnson already has these records from a case he litigated against him in 2000.
In a statement, the Bronx politician hinted that Johnson was doing political dirty work for the Democratic party.
On Tuesday, a court refused to invalidate last week's power grab by Republicans, who elected Espada to temporary president of the Senate. Now both sides refuse to budge on who the leader of the Senate is.
